ME BUSINESS Privacy Policy

General

1. N.F.O SOFTWARE DEVELOPMENT LTD (“We,” the “Company”) operates ME BUSINESS (“ME BUSINESS or the “Platform”), a platform built for business clients, that is an upgrade of the Private Account in the ME application (the “Application”). In addition to the Application, the Company operates a website at the address: https://me.app (the “Website”), which provides access to the Platform online, and information regarding the Company and its services.
2. Capitalized terms used but not defined herein shall have their respective meanings given to them in the ME BUSINESS Terms of Use.
3. The platform allows Users to present information about their businesses to potential customers and other Application Users, and its purpose is to allow You to create an efficient interaction with Your customers and to allow Your customers to reach You easily. You can turn your contacts and Your conversations into customers and manage that database. In addition, by using the Platform You will be able to create a website that matches the profile that You created in the Platform.
4. This Privacy Policy aims to help You understand what kind of information we collect about You, why we collect it, what uses are made with it, whether it is being transferred to others, and why, and to help You understand how You can exercise Your rights under the privacy protection laws applicable to Us, and in particular by the General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act of 2018 (“CCPA”) and the Israeli Privacy Protection Law 5741-1981 and the regulations enacted thereunder (“Applicable Data Protection Law”). In addition, this Privacy Policy describes information security and privacy practices that We apply for protecting and securing Personally Identifiable Information.
5. “Personally identifiable information” is information regarding a specific person or information that can be used to identify a specific person such as ID. No., location data, telephone number, financial information, employment information, etc. (hereinafter: “Personally Identifiable Information” or “PII”).
6. “Non-Personally Identifiable Information” is information that is not related to a specific person or that cannot be used to identify a specific person. The limitations and the requirements laid down in this Privacy Policy regarding the manner of collection, use, exposure, transmission, storage, and saving of such information do not apply to Non-Personally Identifiable Information. Because Non-Personally Identifiable Information cannot be used to identify a specific person, the Company is entitled to use it in any manner that is not prohibited under the law.
7. We will use Your PII only in accordance with the Applicable Data Protection Law and this Privacy Policy.
8. This Privacy Policy applies to the Platform and constitutes an integral part of the Platform Terms of Use and these, jointly with the Privacy Policy and the General Terms of Use that You confirmed upon registration to the Application, constitute a binding legal agreement between You and the Company.
9. To register and making an efficient and proper use of the Platform, You might be required to provide PII (such as contact information, email address, etc.). You are hereby informed that You are not bound by law to provide these information and You declare that the provision of this information to the Company for registration is made out of Your own free will and with Your full consent to the Privacy Policy and Terms of Use. Before using the Platform and providing PII, You are required to carefully read the terms of the Privacy Policy and ensure that You understand them. Using the Platform shall be deemed as Your express consent to all terms outlined in the Privacy Policy. If You don’t accept any of these terms, You may not use the Platform in any way.

PII Collected and Processed By Us

1. Collection of Personally Identifiable Information

1. 1. While using the Platform, You might be required to provide PII, it is also possible that PII will be collected automatically by the Company subject to Your approval and/or according to regulatory requirements. The Company receives, collects, processes and stores the information solely for the purpose of providing its services and conducting its business. This information, that is provided by the data subject (the person subject matter of the data) or that is collected with data subject’s approval, is essential for the provision of the services by the Company and/or that is required for the purpose of complying with statutory duties applicable to the Company and/or is intended for legitimate interests of the Company. The Company uses the information subject to this Privacy Policy, and Applicable Data Protection Law.

1. 1. PII that will be provided to Us or collected automatically might include the following:

1. 1. 1. Contact information, such as first and last name, telephone number, business address, email address and/or contact methods.
    2. Technical information transmitted from Your Device and statistical data such as type of Device, model, hardware, operating system, internet services provider, and the IP address transmitted from user’s Device.
    3. Statistical information relating to the scope of the use of the Platform, including date and time of use, duration of use, frequency of use, usage history, online connectivity, etc.
    4. Geographic location of Your Device. Location data that the Company collects from Your Device depends on Application settings. You can set the access level to Your location data in such a manner that this data will be collected “always” (i.e., when the Application is active and when the Application is shut down), “while using the application” or “never.” To the extent that You decide to disable the collection of location data (by selecting “never”), it is possible that services related to location data will not be available to You.

You may change at any time the settings and the manner of collection of location data at the Application settings according to Your preferences. The Company will be entitled to collect and/or store the said data, segment, and analyze such data, including for the purpose of providing the services, optimizing the services, making the services compatible with the user’s requirements, and providing personalized location promotions. The Company might convert the data that was collected into anonymous data and use the data for the commercial and/or internal needs of the Company.

1. 1. 1. Any information that You upload to Your profile in the Platform, such as a profile picture, a video showing Your business, name, contact information, etc.
    2. Your activity in the Platform, such as profiles You viewed, profiles that you rated, or reports that You submitted. of Social media profiles You linked to Your account, conversations and list of contact persons, reports and blocks of phone numbers, search of contacts in the Device, incoming text messages, purchases and payment in the Platform and other options of use, to the extent that the Company offers these from time to time.

1. 1. Part of the access permissions and the options of use in the Platform may be activated and/or suspended and/or canceled, at the privacy settings in the Account, that can be changed at any time. Thus, for example:
    1. When creating an ME Business Account, a website for the business with the information that You will upload to the Account is automatically created, including your telephone number and email address (unless you decide not to display Your telephone number and email address). This website will be public and accessible to all Users and might appear in online search results etc.
    2. The Platform allows the presentation of contacts who used the service provided by the business. If You decide to disable this option, the business profile will not display information regarding Users that consumed services provided by the business.
    3. The Platform allows You to ask for contact information by clicking a button in the business profile, in such a manner that by clicking the button other users can contact You and leave their contact information. You can disable this option and cancel the option to receive fast queries from users.
2. How We Use PII

1. 1. Providing the services and operating the Platform: the Company uses PII that is provided for the purpose of operating the Platform, including for advertising, and displaying ads, making the information about the business accessible to users, etc.
  2. Processing and analysis: the Company will use Personally Identifiable Information for processing and analysis purposes for the purpose of providing the services and conducting its business.
  3. Internal business use: the Company might use Personally Identifiable Information for internal business requirements including, but not limited to for the purpose of improving the service, upgrading the Application content, offering relevant services and businesses to the User and more.
  4. Collection of anonymous information and collection of information for statistical purposes: the Company might use information for the purpose of creating statistical reports containing aggregate information that does not indicate or reveal the identity of any particular person. The Application might use unique identifiers for its regular and normal operation, and in this regard for the purpose of collecting statistical data regarding the use of the Application, for the purpose of verifying information, making the Application compatible with Your preferences and Your location for information security purposes.
  5. Security, monitoring, and conflict resolution: the Company may use PII for the purpose of protecting the Platform and maintaining its current and normal operation, detecting and preventing cyber-attacks, fraud, phishing, identity theft and data leakages, and for the purpose of resolving conflicts and enforcing agreements.
  6. Data retention and archive: the Company stores Personally Identifiable Information as long as this information is required for the purpose of conducting the business, performing the services and/or for the purpose of performing undertakings in accordance with any law, regulation, regulatory instruction, or contract and subject to this Privacy Policy.
  7. Customer management and customer service: the Company might need access to PII for the purpose of managing customers and providing customer service. In such circumstances as said, the team dedicated to this work is bound by the Privacy Policy of the Company and it is prohibited from using the information, except for customer management and/or customer service purposes required for the purpose of performing their role.
  8. Law enforcement: the Company might use PII in response to a court order, the instructions of a government agency or any other law enforcement authority (including in response to the demands made by the authorities regarding national security requirements or law enforcement), or while acting in good faith and believing that the action is necessary for the purpose of: (a) meeting a legal obligation; (b) protecting the right of the Company and its interests or the interests of third parties; (c) preventing or inquiring service failures; (d) taking urgent action for the purpose of protecting the safety of the users of the Platform or the public; or (e) defending against legal claims or legal liability.
  9. Acquiring and payment: payments shall be made by a third-party clearing service providers and therefore the credit information or the payment information is not stored in the Company databases. Nevertheless, it is possible that the Company will be required to verify the User’s identity based on the information that is provided by the User and for the purpose of ensuring that the payments are collected.
  10. Contacting you: while using the Platform, it is possible that specific services will require the use of a text messaging system (SMS) and/or emails and/or transmission of notification or in-app messages, for the purpose of making the communication with You more efficient, and for the purpose of managing and improving the communication with You, operating, verifying, identifying or performing any other action that will be required for the proper operation of the service that is requested by Your Device. When using the Platform, You will be required to confirm Your approval to receive messages or notifications as may be required as said. In addition, the Company shall be entitled to operate a PUSH service for different messages to the mobile phone number You provided upon registration. You agree that at the time of registering to the Platform and providing information about You to the Company, the Company shall be entitled to contact You, from time to time, and present marketing offers and different benefits. It is clarified that You shall be entitled to cancel Your approval at any time and no longer receive the information by the using the cancellation options that will be stated in the messages and in accordance with the provisions of the law.
  11. The Company uses Cookies and different tracking and monitoring technologies for its regular and normal operation, for the purpose of collecting statistical data regarding the use of the Application, for the purpose of verifying information, making the Application compatible with Your personal preferences, for marketing and information security purposes. It is possible that the providers of the technological services as said will collect the information about You and will use it in accordance with their privacy protection policy and for their personal uses. There are at present technologies that include the option to avoid the collection of Cookies and/or that prevent tracking technologies. You may set in Your Application/Device by option whether to use Cookies and/or apply different solutions for the purpose of disabling such tracking. Some of the Cookies might be required for the operation of the Application and it is possible that by blocking them the service will be affected and/or it will be impossible to provide service and/or that the User’s experience will be affected. By using the Application, You agree to the collection of the information as said and for its use by Us and/or by the operators of the technology as said.
  12. Specific purposes: the Personally Identifiable Information that is provided for a specific and defined purpose shall be used solely for that purpose. Thus, for example, when receiving a query to contact by email address and/or telephone number, the Company will use the information for the purpose of answering the query or, for example, to identify You during Your repeated logins to the Platform, and for the purpose of saving the time in typing your information each time you log in the Platform.
  13. If the Company is required to use PII, in a manner that is not stated and defined in this Privacy Policy, the data subject shall receive a notice regarding its intention, in advance or while using the information.
  14. If You have reasonable grounds for assuming that any of the instructions set forth above was not fulfilled or that You wish to object to the use of the information (and it might affect our ability to provide You the services), we shall be grateful if you could notify the Company immediately in the email: [email protected].

1. Transfer, sharing, and exposure of PII

1. 1. The Company will not share Personally Identifiable Information without obtaining Your approval, unless this is essential, as decided by the Company in good faith and at its discretion, and for the purpose of performing the services and for the purposes as stated in this Privacy Policy.
  2. The Company might share Personally Identifiable Information with its partners, contractors and/or suppliers that process for the Company Personally Identifiable Information for the purpose of conducting the business activities of the Company. The information that will be provided includes Personally Identifiable Information and will be information that is relevant solely for the purpose of performing their role and solely within the framework of and by the different services of the Company, and any other service or interface that the Company will develop and launch in the future and that will grant access to or that will use the database. In addition, the Company will ensure that the information is saved and used in compliance with this Privacy Policy.
  3. As part of the services, the Company presents to the User, according to the permissions that were granted, the information that the User provided and/or the information that was collected about the User, basic identifying information regarding other Users in the Platform, such as contact information and reliability of the information of the contact. You are informed that any user, customer, subscriber, or any other third party that might receive your basic contact information is prohibited from searching, browsing, inquiring, or filtering random numbers, consecutive numbers, or numbers that are irrelevant to the third party with which the basic contact information was shared.
  4. Sale, merger, restructuring, liquidation, etc.: Personally Identifiable Information might be included as part of the assets that will be transferred upon the occurrence of the events described above. Whoever steps in and takes over the Company or the buyer of the Company shall continue to hold the right to use Personally Identifiable Information subject to this Privacy Policy.
  5. Third-party ads: The Company might use third party services to manage the advertisements on the Application. The ads that You will view while using the Application are displayed by the use of the technological measures of the said third parties. To manage their ads, these companies use Cookies in the Application. The Cookies allow these companies to collect information about the applications You viewed in the ads they placed and the ads that you clicked. The use that these companies make with the Cookies is subject to their privacy policies and not to the Privacy Policy of the Company. If You wish to know whether this is an ad of another company or of the Company, you may contact the Company by email and receive more information.
  6. Law enforcement and conflict resolution: in the event of a legal dispute between You and the Company that will oblige disclosure of Your PII; a judicial order ordering the disclosure of Your PII to a third party; the performance of actions in the Platform in violation of the law and the enforcement of the agreement, or out of good faith belief that the disclosure of Your PII is required for the purpose of (a) performing a legal obligation; (b) protecting the rights, interest or the property of the Company or of others; (c) preventing or inquiring possible torts in connection with the Platform; (d) acting under urgent circumstances for the purpose of protecting the safety of users; or (e) protecting the Company against legal liability.
  7. Reaching out to third parties: if you decide to contact or purchase products and services from third parties that offer them for sale on the Platform, the information shall be transmitted to third parties if they require the information for the purpose of completing the purchase process and/or performing the services.
  8. Cloud services: the Company might share Personally Identifiable Information with providers of cloud services, for example, however without limitation, if the cloud service provider requires access to Personally Identifiable Information for securing the information or securing the Platform. In such circumstances as said, the cloud service provider is obligated to comply with the Privacy Policy and information security policy of the Company and may not make any use of the information provided to it, except for the purpose for which it was provided.

1. Third parties

1. 1. For the purpose of performing the services and conducting its business, the Company might process data by third parties. The Company transfers the minimum data that is required for these purposes and only to suppliers whose identities were approved and verified by the Company. Each third party as said might observe an independent privacy policy that regulates the use of that supplier of the Personally Identifiable Information. The Company recommends that you visit these third-party services and read their privacy policy. Third parties processing data for the Company might be:

    2. Service providers for sending and receiving messages – Twilio, 019 Mobile.
    3. Identity verification providers – APPLE, GOOGLE.
    4. Clearing services providers – GOOGLE PAY, APPLE PAY. Payment information is not stored by the Company and forwarded directly to the clearing services providers that use Your information in accordance with their privacy policy.
    5. Analysis providers and search engine providers, that might help the Company in improving the Platform performance.
    6. Data analysis providers, such as Google Analytics, Google Firebase.
    7. Marketing and ad placement providers.

1. Data retention

1. 1. The Company stores Personally Identifiable Information as long as the Company requires such information for the purpose of attaining the purposes for which it was collected, and for the purpose of complying with legal and accounting requirements or for reporting purposes. The Company stores Personally Identifiable Information for the period permitted or required by law. In addition, Personally Identifiable Information that was erased might continue to be stored in backup files or in an archive for an additional period of time, as a result of technical problems or for legal, regulatory, taxation purposes and/or for other legitimate business purposes.
  2. The Company stores the information in databases that are registered and that are managed and protected in accordance with the law.

1. Direct mailing

1. 1. The Company wishes from time to time to send You information regarding the services that the Company provides You, by email. If You wish not to receive direct mailing as said, You may send us an email to the address [email protected] and We will act for the purpose of removing You from this database.
  2. In addition, the Company wishes to send You marketing and advertising materials not within the framework of the services that You consume (for example, messages regarding new services of the Company, offers, special offers etc.). Sending these materials is subject to Your prior consent. You may withdraw from your consent as said at any time, by sending an email to the address [email protected] and We will act to remove You from this database.
  3. In the event You requested to be removed from a specific database and/or withdraw from Your confirmation, however You received by mistake an advertising and/or marketing and/or direct mailing message, please notify Us immediately at the address [email protected] and We will take action to prevent this event in the future.

Information security

1. The Company is obligated to protect PII and data, and for that purpose the Company applies legal, organizational, and technical information security measures, accepted in the industry, for securing PII and protecting it against loss, improper user one access or modification. Nevertheless, these measures do not guarantee full protection, because no server, database, internet network or email account are fully immune from malfunctions or security breaches. If You noticed a risk, a breach, or an information security vulnerability, please report about them immediately to the email: [email protected].
2. The Company acts in compliance with the provisions of the Applicable Data Protection Law, including the Protection of Privacy Law 5741-1981, the Protection of Privacy Regulations (Data Security) 5777-2017 and the instructions of the Israeli Privacy Protection Authority.
3. When registering to the Application, User might be required to select a username and a password that will be used whenever the user logs-in the Application. Please note that the User shall be solely obligated to protect the password and the Company shall not be held liable for any unauthorized use of Your account and shall consider any use made in your account as a use made by You. You are required to examine carefully what information You shared and with whom you decided to share such information.
4. The Company shall not be held liable for any damage caused to a User or to a third party as a result of loss of Personally Identifiable Information and/or unauthorized use of Personally Identifiable Information in consequence of an event over which the Company has no control and/or that stems as a result of a force majeure and/or software or hardware or communication disruptions or as a result of the disclosure of the User’s login information or access to the Device from which the User connected.

Data subject rights

1. Subject to the Applicable Data Protection Law and subject to different exemptions, the User shall have the following rights:

1. 1. User shall be entitled to receive (a) confirmation whether and where We process Personally Identifiable Information about User; (b) categories of the PII We process; (c) purposes for which We process Your PII, and information regarding the manner We set retention periods of the information; (d) information regarding the categories of third parties to which We might transfer PII, and (e) a copy of the PII about User.
  2. A User who found that the PII is inaccurate/deficient/outdated shall be entitled to request to amend this information, limit the use of such information or erase it, to the email [email protected], and request that the Company will transfer the Personally Identifiable Information to another service provider, and to withdraw consent to process the data at any time.
  3. Under certain circumstances, User is entitled (a) to request to limit the purposes for which We process Personally Identifiable Information about the User; (b) object to certain processing actions, subject to the legitimate interests of the Company and its duties – You should be aware that there might be material reasons for the continuation of processing of the Personally Identifiable Information and we will review Your request and notify You if this is the case.
  4. In addition, if the information stored in the databases of the Company is used for direct mailing purposes (direct message to You), in accordance with the provisions of the Protection of Privacy Law 5741-1981, you shall be entitled:

    2. To limit the provision of the information to third parties, whether specific or in general, for a limited or indefinite period of time;
    3. To file an official complaint with the supervising authority of the Company.

1. We will not treat the User adversely in respect of any request to exercise a right that the User may exercise within the framework of the Applicable Data Protection Law and We will not deny the use of the Platform or provide services in a lower level or standard.

Changes in the Privacy Policy

1. The services of the Company might change from time to time and/or it is possible that the provisions of the Applicable Data Protection Law will change from time to time and therefore, consequently this Privacy Policy will also be subject to changes. The Company reserves the right to amend, change or perform modifications in the Privacy Policy at its discretion and at any time (hereinafter: the “Updates”).
2. Updates in the Privacy Policy will be published with an indication of the date “last update” in the title of this policy. The user is responsible for examining the content of these Updates. Please read the Privacy Policy from time to time, and in particular before You provide Personally Identifiable Information. This Privacy Policy was recently updated on the date stated above and the continuation of use of the Platform after the implementation of changes in the policy attests to their acceptance. If You do not accept any change, You are required to discontinue using the Platform.

Children

1. The Company does not collect knowingly information of children under 16 years of age, without obtaining the express consent of a parent or a legal guardian. To the extent that the Company finds that the information that is collected is of a chiled who is under 16 years of age, the Company shall endeavor to the best of its ability to erase the entire information as said.
2. Nevertheless, to the extent that the Platform was reasonably and properly used by a child as said, the Company reserves its right to charge payment for the use as said and keep the information that the Company requires for that purpose.

1. This Privacy Policy applies to the Platform and the services provided therein and does not apply to services or internet websites of third parties related to the Platform, or third parties whose services or products are distributed by the Company. The links and references in the Company Application do not mean that the Company endorses these websites or services, or that the Company examined them in every respect. The Company recommends that you contact the third party for the purpose of inquiring about the privacy policy that is practiced in its organization.

Survivability
1. To the extent that any of the conditions set out in this Privacy is held illegal, invalid, or unenforceable in any respect, the said condition shall be stricken from the Privacy Policy and the legality and validity of the other sections shall not be impaired thereby. In such circumstances as said, any other similar and/or implied condition that is enforceable shall be upheld instead of the condition that was stricken.

Conflict resolution

1. The supervisory authority of the Company is the Israeli Privacy Protection Authority, which its contact information can be found in the website, in the following URL:
